Nerdanatix LLC has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. In addition, Nerdanatix LLC will not and cannot censor or edit the content of any third-party site. By using the Website, you expressly relieve Nerdanatix LLC from any and all liability arising from your use of any third-party website. In that case, Nerdanatix LLC will not hold the responsibilities of consequences and effects that mat may took place in the events when Minors are accessing materials and content that are not intended for them, when they are accessing materials that are marked in any manner, expressed or implied, such as, but not limited to forum names, forum or thread links or forum descriptions.

SELLERS/CREATORS

The Site and all of its content (“Content”), including all copyrights, patents, trademarks, service marks, trade names and all other intellectual property rights therein (“Intellectual Property”), are owned or controlled by Nerdanatix LLC, our licensors, sellers (creators), and certain other third parties. All right, title, and interest in and to the Content and Intellectual Property available via the Site is the property of Nerdanatix LLC, our licensors, sellers or certain other third parties, and is protected by U.S. and international copyright, trademark, trade dress, patent and/or other Intellectual Property and unfair competition rights and laws to the fullest extent possible. Nerdanatix LLC owns the copyright in the selection, compilation, assembly, arrangement, and enhancement of the Content on the Site.

Creators must register to become sellers on the Nerdanatix LLC Website. In some instances, Nerdanatix LLC may also require additional registration to gain access to certain Site areas or services. If you choose to register on our Sites, you agree to (a) provide accurate, current and complete information about yourself as prompted by the applicable registration form, and (b) maintain and update your information (including your e-mail address) to keep it accurate, current and complete. You acknowledge that, if any information provided by you is untrue, inaccurate, not current, or incomplete, we reserve the right to terminate your use of our Sites. You (or your parent/legal guardian if you are a minor) must be the email account holder for any email addresses that you list in your account information or subsequently provide in connection with the Sites. You will be responsible for the confidentiality of your username and password and agree not to transfer or resell your use of or access to the Sites to any third party. If you have reason to believe that your account with us is no longer secure, you must immediately notify us by email at nerdanatix@gmail.com.  YOU ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR USERNAME AND PASSWORD AND FOR ANY AND ALL ACTIVITIES (INCLUDING PURCHASES, AS APPLICABLE) THAT ARE CONDUCTED THROUGH YOUR ACCOUNT.

To use the Nerdanatix LLC seller service you authorize us to charge any Payment Method associated with your account and sales 8% in commission. If you have received a payout and have not paid your commission fees to Nerdanatix LC with your sales or a primary Payment Method is declined or no longer available to us for payment, you will remain responsible for any uncollected amounts. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not cancel your account until payment is complete, we may suspend your access to the service until we have successfully charged a valid Payment Method. After 30 days if a payment has not been settled or Nerdanatix LLC has not been contacted, we reserve the right to terminate your access to the service. As of now commission percentages will be automatically deducted from all sales, digital and physical.

Your use of the Sites creates a legally binding agreement by and between you and Nerdanatix LLC. By signing up, posting or displaying content on, to, or through Nerdanatix LLC Website (or its sub-domains, successors, social media and affiliates), you grant Nerdanatix LLC a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, display and perform such content on Nerdanatix LLC Website (or its sub-domains, successors, social media and affiliates). Nerdanatix LLC reserves the right to syndicate User Submissions submitted, posted or displayed by you on or through Nerdanatix LLC Website (or its sub-domains, successors, social media and affiliates) and uses that content in connection with any service offered by Nerdanatix LLC. The aforementioned license granted by you terminates once you remove or delete your account from Nerdanatix LLC. You also acknowledge that Nerdanatix LLC may retain, but not display, or distribute, any content that was uploaded to Nerdanatix LLC Website, after your day of termination. Nerdanatix LLC will do its best to remove any and all content but will not be held liable for any content that was uploaded prior to your day of termination. In addition, you acknowledge and grant users of the Nerdanatix LLC Websites a non-exclusive license to access the account through the Nerdanatix LLC Website (or its sub-domains, successors and affiliates) and to use such account information as applicable by their respective licenses.

You must own or have the necessary licenses, rights, consents, and permissions to use and authorize Nerdanatix LLC to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all content to enable inclusion and use of the content in the manner contemplated by the Website and these Terms of Service; and you have the written consent, release, and/or permission of each and every identifiable individual person in the content submitted to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Service. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead us as to the origin of any User Submission submitted by you. You agree to indemnify Nerdanatix LLC for all claims arising from your claims to any rights in any content submitted. You shall be solely responsible for your own content and the consequences of posting or publishing them.

 

You understand that when using the Nerdanatix LLC Website, you will be exposed to viewers from a variety of sources, and that Nerdanatix LLC is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to your submitted content. You further understand and acknowledge that you may be exposed to viewers that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Nerdanatix LLC with respect thereto, and agree to indemnify and hold Nerdanatix LLC, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.
